According to the proposals in the document, the responsibility for repeated violations of the rules for entering into marriage with a person who has not reached the marriageable age will be significantly tightened. If such an offense occurs again after an administrative penalty, a fine of 50 to 100 basic calculation amounts (BCA) is provided, which amounts to 20.6 to 41.2 million sums, or mandatory community service from 240 to 300 hours, or corrective labor for up to two years.
For comparison, according to current legislation, a fine for similar actions ranges from 20 to 30 BCA, mandatory community service up to 240 hours, or corrective labor for up to one year.
The draft law also introduces a ban on marriages between relatives of the collateral line of kinship in the second, third, and fourth degrees. This applies to marriages between:
- uncles and nieces;
- aunts and nephews;
- cousins, second cousins, and third cousins.
Currently, the Family Code of Uzbekistan already has prohibitions on marriages between relatives in the direct ascending and descending lines, as well as between full and half-siblings, including adoptive parents and adopted children.
In addition, the draft law proposes to establish a provision whereby the district or city hokim can reduce the marriageable age by one year upon receiving an application from individuals wishing to marry if it is related to pregnancy or the birth of a child.
The document also stipulates a fine of 70 BCA for entering into marriage or actually entering into marriage in cases where there are legal obstacles.
