New Rules Established for the Protection of Children's Rights in Criminal Proceedings

The President of the Kyrgyz Republic, Sadyr Japarov, has approved a new draft law "On Amendments to Certain Legislative Acts of the Kyrgyz Republic (to the Criminal Code and the Criminal Procedure Code)," which was endorsed by the Jogorku Kenesh on September 25, 2025.

The purpose of this law is to improve the protection of the rights of children who find themselves in conflict with the law, as well as to enhance alternative procedures and create more favorable conditions for their resocialization.

Additionally, the law aims to eliminate shortcomings present in the Criminal Code and the Criminal Procedure Code, as well as to address issues arising in law enforcement practice related to the exclusion of minors from the criminal process.

According to this law, it is proposed:

– to impose on the authorized body for the protection of children's rights the duty to create a list of obligations for the child, based on a conclusion drawn from an analysis of their life situation and socio-psychological characteristics, as well as to propose deadlines for fulfilling these obligations. These proposals will serve as the basis for the investigator to take measures aimed at excluding the child from the criminal process;

– to introduce a written warning as a separate procedural procedure and the obligation of the investigator to issue it simultaneously with the conclusion of the exclusion agreement;

– to eliminate shortcomings regarding changes to measures, extensions of the agreement deadlines, and cancellations of decisions on the exclusion of the child from criminal proceedings, as well as to establish deadlines for the prosecutor's approval of the ruling and the exclusion agreement;

– to define clear timelines for the procedure of excluding the child from the criminal process and other measures.
