It is worth noting that the law was approved by the Jogorku Kenesh on September 25 of this year.
The main goal of the new amendments is to improve the protection of the rights of children in conflict with the law, as well as to create better conditions for their resocialization and alternative measures.
According to reports, the law also aims to eliminate shortcomings in the existing Criminal and Criminal Procedure Codes, as well as to address practical issues related to the process of removing children from criminal proceedings.
Among the key provisions of the law:
- The authorized body for the protection of children will be required to compile a list of duties for the child, based on an assessment of their life situation and socio-psychological characteristics, as well as to propose deadlines for the completion of these duties. These proposals will be taken into account by the investigator when making decisions about removing the child from the criminal process;
- The introduction of a written warning as a separate procedural measure, which the investigator will have to issue simultaneously with the conclusion of the removal agreement;
- The elimination of gaps regarding the modification, extension, and cancellation of the decision to remove the child from criminal proceedings, as well as the establishment of deadlines for the prosecutor's approval of the relevant resolutions;
- The establishment of clear deadlines for the process of removing the child from criminal proceedings.
