According to information provided by the president's press service, the main goal of the new law is to improve the protection of the rights of minors who find themselves in conflict with the law, as well as to optimize alternative procedures and conditions for their resocialization.
Additionally, the law aims to eliminate existing shortcomings in the Criminal Code and the Criminal Procedure Code, as well as to address issues arising in the practice of law enforcement when removing children from criminal proceedings.
As part of the new legislation, it is proposed to:
– impose on the authorized state body for child protection the duty to compile a list of responsibilities for the child, based on the results of an analysis of their life situation and socio-psychological characteristics, and also to propose a deadline for fulfilling these responsibilities. These proposals will serve as the basis for the investigator to take measures aimed at removing the child from criminal proceedings;
– introduce a written warning as a separate procedural procedure, with the investigator being obliged to issue it simultaneously with the conclusion of the removal agreement;
– fill gaps regarding changes to measures, extensions of the agreement's terms, and the cancellation of decisions to remove the child from criminal proceedings, as well as establish a deadline for the prosecutor to approve the relevant resolutions and agreements;
– define clear deadlines for the process of removing the child from criminal proceedings and other changes.
