
Former chairperson of the Ton District Court of the Issyk-Kul region, Gulzat Abdinasirova, has sent a letter to the President, the head of the GKNB, and the chairperson of the Supreme Court of the Kyrgyz Republic.

I, Gulzat Abdinasirova, was detained on September 27, 2024, on suspicion of corruption, but I am confident that the criminal case against me is fabricated, initiated at the request of a person connected to the plaintiff, his son Urmat Imanaliev, who works in the GKNB of the Kyrgyz Republic.
I am ready to defend my rights within the framework of an open court process. However, serious violations of legislation and principles of justice occurred at the early stages of the proceedings, raising doubts about the objectivity and fairness of the court proceedings.
During the preliminary investigation, Urmat Imanaliev acted as a witness, but his testimony was not properly verified by either the first-instance court or the appellate court. My motions for his interrogation were rejected, which I believe violates the requirements of the Criminal Procedure Code of the Kyrgyz Republic and hinders a comprehensive judicial review.
I also ask you to take measures for the early dismissal of the judges of the Bishkek City Court: Ataev Z.I., Baidaeva L.A., and Esenbaev A.M. I believe that these judges have committed gross and systematic violations of the law throughout the process, as well as violated my procedural rights and norms of professional ethics.
The actions of the presiding judge Ataev Z.I. can be characterized as an abuse of power, as he effectively considered and resolved motions unilaterally, undermining the meaning of collegiality and the principles of appellate proceedings. Judges Baidaeva L.A. and Esenbaev A.M. displayed inaction and negligence towards their duties. As seen from the video recordings of the hearings, they were preoccupied with mobile phones and effectively distanced themselves from the process, while the law requires active participation of appellate judges in the proceedings.
This behavior is a gross violation of the principles of publicity and immediacy of judicial proceedings, which hinders an objective assessment of the evidence and undermines trust in the judicial system. The actions of these judges contradict the Code of Judicial Ethics of the Kyrgyz Republic, which requires judicial workers to maintain a high level of professionalism and respect for the participants in the process. The use of phones during hearings demonstrates a disregard for duties and participants, raising justified doubts about the impartiality of the court.
Throughout the process, my lawyers and I repeatedly filed motions to disqualify the entire court composition, including Judge Baidaeva L.A., who, in addition to her passive behavior, allowed herself disrespectful reactions and smirks, creating an unhealthy atmosphere. Her closeness to the chairperson of the Bishkek City Court, Abikeev Talaybek Kaparovich, also raises concerns regarding the independence and impartiality of justice.
In light of the above, I request:
— to conduct a service investigation regarding judges Ataev Z.I., Baidaeva L.A., and Esenbaev A.M.;
— to provide a legal assessment of their actions and behavior;
— if violations are confirmed, to take the legally prescribed disciplinary measures, including the possibility of early dismissal from office.
This decision will help strengthen trust in the judicial system and protect the principles of legality and justice.
