
The Ministry of Justice of the Kyrgyz Republic has presented a draft resolution of the Cabinet of Ministers for public discussion regarding the rules for the registration of mass media.
The purpose of this document is to implement the provisions of the Law of the Kyrgyz Republic "On Mass Media" and to establish a transparent and orderly mechanism for the state registration of media.
The justification for the draft states that it has been developed in accordance with paragraph 3 of Article 34 of the media law, which obliges the Cabinet of Ministers to adapt its regulatory acts to the new legislation within six months.
The proposed provision is a subordinate regulatory act and regulates the relationships arising in the process of state registration of media. In particular, the document defines:
- the procedures for registration, re-registration, and termination of media activities;
- the legal status of applicants;
- the powers of the authorized state body;
- the deadlines and grounds for making administrative decisions.
The document implies a differentiated approach to media registration, taking into account various types, forms of distribution, and publication frequency, which, according to the Ministry of Justice, corresponds to the principle of technological neutrality and modern requirements of the media sphere.
Moreover, the document describes the procedures for making changes to the founding data of media, such as name, language, distribution territory, composition of founders, and thematic focus.
The ministry emphasizes that the adoption of this provision will contribute to the observance of legality, legal certainty, and the unification of law enforcement practices, while not restricting constitutional rights, including freedom of expression and the dissemination of information.
