The rules of notarial activity have been updated in Kyrgyzstan

The Ministry of Justice of the Kyrgyz Republic has presented updated rules for notarial activities, which were approved by the resolution of the Cabinet of Ministers of the KR No. 121, dated February 19, 2026.

According to the new rules, the fee for notarial services must now be paid through a payment platform that is integrated into the Unified Information System of Notaries (EISN) on the day of the notarial action and the issuance of the relevant documents. The system records the payment status, which will be stored to confirm the fact of payment. It is also established that the texts of notarial inscriptions will be generated exclusively through the EISN.

The changes also concern the procedure for concluding several important agreements. A marriage contract, a surrogacy agreement, agreements for the transfer of a child to a foster family, as well as contracts for lifelong maintenance, permanent rent, and alimony must now be concluded in person by the parties. The execution of such transactions through representatives is not allowed.

Now, the consent of parents, adoptive parents, guardians, or custodians for the departure of minors outside the country, as well as for permanent residence abroad with one of the parents (guardian, custodian) must be formalized for a specific period.
The new rules also clarify the procedure for notarial orders. In particular, requirements are specified for cases where collection occurs based on a notarized transaction, a simple written transaction, on protests of promissory notes, alimony for minor children (in the absence of a dispute over parentage), and for mandatory payments (excluding taxes and insurance contributions), as well as for unpaid wages.

Another important innovation concerns the notification of the debtor. A copy of the notarial order, as before, must be sent within the next day; however, the notary can now send it not only through the postal service with return notification but also in PDF format via email, through messengers such as WhatsApp, Viber, Telegram, or in direct messages.
These changes will come into effect ten days after their official publication.

Previously, several reforms had already been implemented in the notarial sphere, including the launch of remote notarial services for citizens of Kyrgyzstan abroad through the "Electronic Notary" system, the expansion of the accessibility of this service, the pilot launch of the automated information system "Electronic Apostille," as well as the introduction of remote execution of certain notarial actions starting from October 1, 2025. In addition, the qualification requirements for private notaries in inheritance cases have been raised, which contributes to the integration of the notarial system of Kyrgyzstan into the international professional community.
