Starting from January 30, 2026, public discussions will begin in Kyrgyzstan on the draft law "On Amendments to Certain Legislative Acts of the Kyrgyz Republic."
This project was initiated by the deputy of the Jogorku Kenesh, Marlen Mamataliyev.
The proposed amendments will affect the following legislative acts:
- The Family Code of the Kyrgyz Republic;
- The Law "On Civil Status Acts";
- The Law "On the Protection of Citizens' Health in the Kyrgyz Republic."
The explanatory note states that:
- technological progress in medicine significantly outpaces legal regulation, creating gaps in legislation regarding gender change in civil status records;
- the author believes that such practices contradict traditional cultural and spiritual beliefs established in Kyrgyz society;
- existing family law norms, including rules for forming surnames and determining kinship, are strictly tied to biological sex, reflecting the continuity of lineage and traditional understanding of family;
- the document emphasizes that the absence of a clear legislative prohibition may lead to:
- legal issues in family relationships (e.g., in marriage and parenthood);
- risks for justice and enforcement of penalties (e.g., in determining places of serving sentences);
- abuses in military service;
- difficulties for law enforcement agencies in identifying individuals;
- violations of fair competition principles in sports competitions;
- weakening of state registration and digital accounting systems, which contradicts the objectives of e-governance.
