Deputy of the Jogorku Kenesh Marlen Mamataliev has initiated a draft law aimed at introducing a ban on changing gender data in official documents. This draft law has already been submitted for public discussion.

According to Mamataliev, modern medical technologies make gender transition procedures more accessible; however, legislative changes in this area are lagging behind medical advancements, creating a legal vacuum. The deputy notes that issues of gender identity often conflict with established spiritual, religious, and moral values of society, making it difficult to find consensus among citizens.

He emphasizes the existing legal problem that allows changes to be made to gender entries in civil acts and passports based on medical documents. Mamataliev believes that such practices have no historical roots in Kyrgyz society and may pose risks to demographic policy, public morality, national security, and sustainable development of the country.

The deputy also mentioned the first reports on social media regarding appeals to the state institution "Kyzmat," which, according to him, highlights the need to create legislative norms to protect constitutional foundations, traditional values, and the institution of family.

As a justification for his initiative, Mamataliev refers to the Constitution and the Family Code, emphasizing that the concepts of male and female have a clear binary nature and are directly linked to biological sex at birth. In his opinion, the possibility of administrative gender change undermines the foundations of family law, creates legal conflicts, and calls into question traditional notions of motherhood and fatherhood.

Furthermore, the deputy warns that the legalization of gender change in documents could lead to abuses in the fields of justice, military service, crime fighting, and sports, as well as complicate the work of state registries and accounting systems.

In light of the above, Mamataliev proposes to amend the legislation to explicitly prohibit changes to the record of biological sex in civil status acts and other official documents.
