Amendments are being made to the law on assigning a PIN. How is this related to transgender transition?

At the meeting of the Committee on Science, Education, and Information Technologies of the Jogorku Kenesh, held on January 19, amendments to the law concerning the assignment and modification of personal identification numbers (PIN) for citizens were discussed. The current legislation provides grounds under which a PIN can be changed, namely:

The management of the assignment and modification of PINs is carried out by the government.

Deputy Seyidbek Atambaev noted that this bill is intended to protect citizens' rights, but it could also lead to a weakening of the role of the Jogorku Kenesh.

“I support this bill, but we should discuss its shortcomings. On one hand, it grants many powers to the government, which may allow it to change the grounds for modifying a PIN without the consent of parliament, which in turn weakens parliamentary control. The draft lacks a clear list of grounds, and everything will be determined by subordinate legislation, right?” the deputy asked.

In response, the First Deputy Minister of Digital Development Nursultan Kubanov stated that parliament can make changes to the law within its powers.

“I agree, but while supporting the bill, it is also necessary to ensure parliamentary control over subordinate legislation so that changes to PINs are related solely to technical and human rights aspects. The government should inform the Jogorku Kenesh about its actions, or it is necessary to clearly define the grounds for changing the PIN,” Atambaev added.

The Deputy Director of the State Enterprise "Kyzmat" Ernes Dosaliev emphasized that deputies should not worry about the list of grounds being excluded from the law, as they will be transferred to subordinate acts.

Emergency situations arise, such as transgender needs. Recently, we were approached with a request to change the PIN for a man who became a woman. Until his PIN is changed, he will face difficulties in accessing services in the country. This is just a hypothetical example.

Dosaliev added that implementing such gender norms will require significant time. If this issue is addressed through subordinate acts of the government, changes can be made more quickly, which will help resolve citizens' problems.

He also noted that changes to the law are relevant in light of potential transgender and other requests.
