An important innovation is the introduction of a clear definition of an investment agreement — an official contract between the state and the investor that regulates their rights and obligations. These agreements are key to attracting large projects with financing of 1 billion soms or more. The authors of the draft law emphasize that existing norms often have ambiguous interpretations, leading to delays and legal disputes.
Additionally, the proposed changes concern the procedure for providing land plots owned by the state. Now, the conditions for land transfer will be determined by the Cabinet of Ministers for both citizens of Kyrgyzstan and foreign investors.
According to the draft law, land plots for the implementation of national projects can be leased for a period of up to 50 years.
There is also a provision for the phased extension of usage rights, provided that all obligations on the part of the investor are fulfilled.
Significant attention is paid to eliminating legal uncertainty: it is clarified in which cases land plots can be transferred free of charge, when auctions are required, and how the state can include land plots in the authorized capital of companies with state participation. These norms, according to the authors, will help eliminate gaps in legislation and reduce administrative barriers.
The explanatory note to the project emphasizes that the proposed changes are aimed at protecting the interests of investors, increasing the investment attractiveness of the country, and accelerating the implementation of projects significant for the economy of Kyrgyzstan. The document is available for public discussion, and all interested parties can submit their proposals and comments within the established timeframe.
