At Issyk-Kul, the investigation revealed the privatization of land by a farming enterprise with an area inflated by 16 times — the court issued a verdict against the state notary.

In the Issyk-Kul region, a court hearing took place regarding the case of a former state notary who was acquitted in connection with the documentation of land plots in the Ton district.
According to the materials of the case, posted in the State Register of Judicial Acts, I.K.T., acting as a notary of the state notary office of the Ton district, improperly fulfilled his duties, which led to a criminal offense. By order of the Justice Department of the Issyk-Kul region dated June 13, 2003, he was appointed to this position.

According to the investigation, on February 15, 2006, a purchase and sale agreement was concluded at this notary office between the representative T.A.K. and the head of the agricultural farm "B." A.Z. based on a power of attorney issued by the Department of Agricultural Development of the Ton district on February 13, 2006. According to the terms of the contract, A.K.T. sold to Z.A. several properties, including:

— the property "T." with an area of 94.87 square meters;
— an oil depot with an area of 12.86 square meters, with a land plot of 3,114.43 square meters;
— a mechanical workshop with an area of 798.06 square meters and a land plot of 1,242.22 square meters.

The total value of the properties at that time amounted to 12,995 soms. The contract was certified by notary K.I.T., who, according to the investigation, without the necessary confirmations, changed the area of the land plot from 1,242.22 sq. m to 20,714.08 sq. m, which led to a 16-fold increase in area. After that, he certified the document with his seal and signature.
Based on this contract, on June 9, 2006, the Ula-Khol rural administration issued a decree to transfer the land plot of 20,714.08 square meters into private ownership of Z.A.
The investigation also established that the power of attorney issued by the Department of Agricultural Development did not grant the right to privatize property. By a government decree dated November 29, 2004, the Republican Center for Land and Agricultural Reform was established, and the functions of privatization were transferred to the State Committee for Management of State Property. Thus, the Department of Agricultural Development did not have the authority to conduct privatization.

According to Article 21 of the Law "On Notaries," a notary is obliged to act in accordance with the law. In accordance with the requirements of Article 37 of the same law, a notary must verify the legal capacity of citizens and the authority of representatives. Notary K.T.I., certifying contracts based on the power of attorney, did not verify whether A.T. had the right to conclude a purchase and sale agreement with Z.A., nor did he take into account that the mentioned department did not have the authority for the direct sale of state property.

As a result of the negligent performance of his duties, K.T.I. removed a land plot from state ownership, which caused damage to the state. In this regard, the investigation charged the notary under part 1 of Article 331 of the Criminal Code ("Negligence").

On September 23, 2025, the Ton District Court acquitted K.T.I. due to the lack of elements of a crime. The Deputy Prosecutor of the Ton district disagreed with the court's decision and filed an appeal, pointing out the actions of the notary who changed the area of the land plot 16 times, which led to the unlawful transfer of municipal lands.

At the court hearing, K.T.I. did not admit his guilt, stating that he had the right to make corrections based on the technical passport. He also noted that the contract was recognized as legal and requested to leave the court's decision unchanged.

The judicial panel of the Issyk-Kul Regional Court on December 23, 2025, changed the court's decision, clarifying K.T.I.'s right to rehabilitation, while the rest of the verdict remained unchanged.
