In mid-June 2023, the GKNB announced the detention of M.Zh. and A.S., the commercial director of the State Enterprise "Kyrgyzkomur".
According to the state committee, an investigation was initiated regarding employees of the Ministry of Energy and branches of the State Enterprise "Kyrgyzkomur", including "Issyk-Kul Shipping" and the loading and unloading point in Balakchy.
The GKNB noted that the investigation concerned multi-million embezzlement of coal intended for the Bishkek CHPP. It was established that the so-called "coal mafia," consisting of high-ranking officials from the ministry, embezzled over 15,960 tons of coal worth more than 40 million soms during the transportation of coal from Kara-Keche to Balakchy and then to the CHPP in Bishkek from 2021 to 2023.
As a result of the court proceedings in Karakol, M.Zh.M. was acquitted on one count, but the court found him guilty of negligence and imposed a fine of 50,000 soms, as reported by Turmush.
According to materials published in the State Register of Judicial Acts, a representative of JSC "Kyrgyzkomur" filed a petition with the court to reopen the case based on newly discovered circumstances regarding the acquittal by the Karakol City Court for M.Zh.M., who was acquitted under part 2 of Article 348 of the Criminal Code ("Negligence causing by negligence serious or especially serious harm").
In his statement, the representative of "Kyrgyzkomur" indicated that despite the acquittal, M.Zh.M. paid 7 million soms as compensation for damages, which may be interpreted as a partial admission of guilt.
The lawyer noted that only part of the damage amounting to 6 million soms was compensated according to the receipt from A.T.O.
The representative of JSC "Kyrgyzkomur" added that the company continues to incur losses of nearly 6 million soms, considering the already paid 7 million soms, and therefore they insist on reviewing the case and overturning the verdict.
The case materials indicate that M.Zh.M. was acquitted under part 2 of Article 348 of the Criminal Code due to the absence of a crime composition but was found guilty under part 1 of Article 348 of the Criminal Code and fined 50,000 soms. This verdict was not appealed and has entered into legal force.
During the court session, a representative of the victim's side was present and was informed of the right to appeal the decision. All arguments presented in the petition to reopen the case were considered.
On January 28, 2026, the Issyk-Kul Regional Court confirmed the decision of the Karakol City Court and left it unchanged, dismissing the appeal. The ruling takes effect from the moment it is announced, and a cassation appeal may be filed with the Supreme Court.
