Deputy Head of the Osh Branch of "Cadastre" Admitted Guilt in the Case of Illegal Land Transformation — Court Delivered a Verdict

The Osh City Court issued a ruling in the case of the deputy head of the Osh branch of the State Agency for Land Resources, Cadastre, Geodesy, and Cartography, who was detained in connection with an investigation into the unlawful withdrawal and change of the intended use of a land plot.

The court found him guilty of abuse of office, imposing a fine of 220,000 soms, and also depriving him of the right to hold public office for a period of three years.

According to the case materials published in the State Register of Judicial Acts, the individual involved in the case, known as Kuban [name changed to Sh.K.S.], while serving as the deputy director of the Osh branch of the mentioned agency, committed the crime under the following circumstances.

The investigation established that a land plot of 8,000 square meters, located in the Kalinin residential area of Osh city, was leased for 15 years for the construction of a private kindergarten and a school teaching foreign languages. This decision was made by the Osh city mayor's office on October 8, 2003, and was registered in the name of S.N.M.

According to this resolution, on December 28, 2009, the land management department issued a certificate of the right to temporary use of this plot.

Later, on June 20, 2019, the Osh city mayor's office decided to transfer this plot for indefinite use to the municipal property management department of the mayor's office. As a result, on June 22, 2019, a certificate of the right to indefinite use was issued, in which the intended use of the plot was defined as "social, populated area".

In August 2020, citizen Sh.I., who was actually using the plot, submitted an application for its transfer to private ownership through direct sale.

On August 28, 2020, at a meeting of the commission chaired by the vice-mayor of Osh city J.A., a decision was made to deny the transfer of the plot to private ownership, despite its estimated value of 12,480,000 soms, as the plot was classified as a social facility.

Nevertheless, the investigative authorities believe that the head of the municipal property management department A.S., together with vice-mayor J.A. and other individuals, including representative I.I.T., sent a request to the Osh branch of the State Agency for Land Resources on September 10, 2020, asking to change the intended use of the plot.

The request stated that the intended use was not specified in the mayor's resolution of June 20, 2019, and therefore they requested to change it from "social" to "various".

On September 11, 2020, the employees of the Osh branch changed the intended use of the plot, issuing a new certificate of the right to indefinite use, in which the term "social, populated area" was replaced with "various". After that, a new certificate of the right to indefinite use was issued to the municipal property management department of the mayor's office.

Then, the head of the department A.S. brought the issue of selling the plot to the commission for granting ownership rights to municipal land plots. In the absence of vice-mayor J.A., the meeting was chaired by the head of the urban planning department M.I., where the value of the plot was reduced to 10,400,000 soms, and a decision was made to sell it through auction.

However, A.S., not implementing this decision and not obtaining the site plan, put it up for electronic auction at a reduced price. As a result of the auction, held according to government resolutions, N.M.M. offered 12,480,000 soms and became the winner.

By the mayor's resolution of June 9, 2021, the plot was transferred to private ownership, and on the same day, a sales contract was concluded between A.S. and N.M.M.

Subsequently, Kuban, while serving as deputy director, registered the plot for N.M.M. in the registry on June 22, 2021, producing a certificate of private ownership. To conceal the traces of the crime, the intended use of the plot was changed back to "social".

N.M.M. divided the plot into four parts, which began to be used for commercial activities. According to the report of the consulting agency "Tüshtük Land Reform" dated December 24, 2025, the market value of these plots amounted to 200 million soms.

On December 25, 2025, N.M.M., along with N.A.M., N.I.M., and Sh.R.A., who were illegally owning the plots, transferred them back to the municipal property management.

Kuban's actions were qualified by the investigative authorities under part 3 of Article 320 of the Criminal Code (2017 edition) as abuse of office.

During the pre-trial proceedings, the lawyer and Kuban himself requested to conclude a plea agreement under Article 500 of the Criminal Procedure Code.
On December 26, 2025, a plea agreement was signed between prosecutor B.Suyunbekov, investigator Ö.K., the lawyer, and Kuban, under which he was to pay a fine of 220,000 soms.

The court recorded the agreement on December 26, 2025. During the court hearing, Kuban admitted his guilt and expressed remorse, asking for a fine to be imposed in accordance with the agreement.

On January 22, 2026, the Osh City Court ruled to find him guilty under part 3 of Article 320 of the Criminal Code, imposing a fine of 220,000 soms and depriving him of the right to hold public office for three years.

The fine will be collected in favor of the state. The preventive measure in the form of house arrest will remain in effect until the verdict enters into legal force and will be lifted thereafter.
The verdict is subject to appeal within thirty days to the Osh Regional Court.
