Google accused of spying on users through Gemini AI. A class action lawsuit has been filed in the USA.

The lawsuit claims that Google activated Gemini AI by default in services such as Gmail, Google Chat, and Google Meet without users' knowledge. Previously, users had the option to enable this feature themselves; however, now, according to the plaintiffs, the forced activation allows the company to collect data without users' consent.

To disable Gemini AI, users must manually change their privacy settings. Otherwise, as stated in the document, this tool gains access to the entire history of personal messages in Gmail, including every sent and received email, as well as attachments and correspondence.

The plaintiffs are accusing the company of violating the California Invasion of Privacy Act (1967), which prohibits the recording and interception of confidential messages without the consent of the participants.

It is worth noting that in September, a court ruling in San Francisco found Google guilty of violating privacy, resulting in a fine of over $400 million. This lawsuit, filed in 2020, involved 174 million devices, and the plaintiffs claimed that the company had been unlawfully collecting data for eight years, even when the "app and web activity" feature was turned off.
