In Kazakhstan, correspondence in WhatsApp will have legal force as part of a contract

In Kazakhstan, deputies led by Murat Abenov announced amendments to the legislation, according to which correspondence in messengers, including WhatsApp, and voice messages can have legal force as elements of a contract. He reported this in a live broadcast on the Instagram account of the Mazhilis, as reported by Tengrinews.kz.

The deputy noted that the new legislative norms expand the understanding of the form of a contract, especially in conditions where most transactions are conducted online.

“We have taken into account important aspects, such as the form of the contract. Nowadays, many of us do not have signed documents, as everything happens on the internet. Any conversation we have, video recordings, correspondence in WhatsApp, and even advertisements can be considered part of the contract. If we had correspondence, or I transferred money to you via Kaspi, and you promised a three-year warranty, all of this is part of the contract,” explained Murat Abenov.
He also emphasized that now sellers and service providers will not be able to evade their obligations by using the absence of a signed document as an excuse.
“If obligations are not fulfilled, the seller cannot claim: ‘We did not have a contract, I did not sign anything.’ All our correspondence will be considered part of the contract. We are specifically outlining this to protect citizens, as companies have powerful legal departments, while ordinary citizens may find themselves unprotected,” he added.

In Murat Abenov's opinion, the implementation of this norm should strengthen consumer rights and reduce the number of conflicts between citizens and businesses.
