Criminal Record for Alimony: Dastan Bekeshev Believes That Fathers' Debts Will Impact Children
Bekeshev noted that the bill provides for the introduction of criminal liability for those who fail to fulfill their alimony obligations.
The parliamentarian emphasized that if fathers are convicted for non-payment of alimony, it could negatively impact their children's future. For example, such children may face difficulties when seeking employment in law enforcement agencies due to their parents' criminal records. "Thus, the father not only fails to provide for his child but also creates additional barriers in life for them," he noted.
Deputy General Prosecutor Umutkan Konkubaeva added that criminal liability would only apply to those citizens who have not fulfilled their alimony obligations for a year. If obligations are not met within three months, such citizens may face administrative penalties, including a three-day arrest.
Deputy Kubanychbek Samakov criticized the bill, expressing concerns that the adoption of this law would lead to a sharp increase in the number of complaints against alimony non-payers. "If we currently have 60,000 such people, after the adoption of the law, their number could rise to 300,000. This will result in our inability to accommodate everyone in temporary detention facilities," he said.
Samakov proposed considering alternative measures, such as property seizure, travel bans, and restrictions on civil transactions.
As a result of the discussion, the deputies adopted the General Prosecutor's bill "On Amendments to Certain Legislative Acts in the Field of Enforcement Proceedings" in the first reading. This document introduces the institution of private bailiffs and toughens penalties for those who evade alimony payments.
