At the meeting, amendments to several legislative acts concerning enforcement proceedings were presented. The draft law includes not only the rights and obligations of private bailiffs but also their responsibilities, as well as provisions regarding the non-fulfillment of alimony obligations.
If the alimony agreement or court decision on alimony payments is not fulfilled, the bailiff is obliged to prepare and send a report to the court in accordance with the Code of Offenses. In cases of arrears exceeding 12 months, the materials will be forwarded to law enforcement agencies.
The Deputy Attorney General also emphasized the following measures:
- for arrears over three months — arrest for three days;
- in case of repeated violations within a year — arrest for seven days;
- for non-payment of alimony for 12 months — community service from 100 to 200 hours or imprisonment for up to one year;
- hiding income or evading employment by court decision results in a fine of 100,000 soms or imprisonment for up to three years.
Some deputies supported the idea of strict punishment for those who evade alimony. Dastan Bekeshev suggested abolishing alimony and instead providing benefits to children from the state, while obligating the evading parent to work for the government.
As a result of the discussion, the committee members adopted the draft law in the first reading.
