According to information, an investigator from the Karakol City Department of Internal Affairs applied this measure to two citizens. Representatives of the monitoring department of the Ministry of Justice installed special electronic bracelets on the suspects and connected a mobile application for monitoring.
Electronic monitoring is a device designed to track the movements of individuals who are subject to restrictions on their freedom. The bracelet cannot be removed without authorization, and monitoring is carried out through a special application of the Ministry of Justice.
The main objectives of implementing electronic monitoring are:
— to monitor compliance with restrictions and prohibitions imposed on the accused;
— remote monitoring.
This measure is not applied:
— in cases of particularly serious crimes;
— in serious crimes covered by Section VI of the Criminal Code of the Kyrgyz Republic.
The decision to implement electronic monitoring can be made by:
— an investigator, prosecutor, investigative judge, or court;
— upon a petition from the accused, their lawyer, or legal representative.
The documentation specifies:
— the territory beyond which the accused is not allowed to go;
— the established restrictions and prohibitions;
— the body or person exercising control.
The following obligations are imposed on the accused:
— not to leave the designated territory without the bracelet;
— to comply with the established prohibitions and restrictions;
— not to interfere with the investigation and court proceedings;
— to appear when summoned at the designated time.
In case of violation of the conditions of electronic monitoring, another preventive measure will be applied to the accused.
This is the first experience of implementing this mechanism, which aims to ensure public safety while respecting human rights in accordance with the legislation.
