The new law will ensure food safety "from farm to table" — text
This document will come into force one year after its official publication.
Changes in Legislation
Farm-to-Table Approach: new requirements apply to all aspects: production, import, storage, transportation, sale, and disposal, as well as materials and products that come into contact with food and animal feed.
Risk Analysis: the introduction of risk assessment and management based on the recommendations of the "Codex Alimentarius" and the Animal Health Code.
Traceability: a mandatory accounting and documentation system at all stages, as well as a state information system with unique identifiers for each product.
Conformity Assessment: state registration of specialized and new products, veterinary examination of primary producers, as well as declaration of conformity before release or import.
Recall and Withdrawal: unsafe or expired products can be voluntarily recalled by the manufacturer or withdrawn by order of the authorized body.
Business Process Requirements: production control programs, hygiene practices, storage and transportation conditions, as well as labeling in state and official languages.
Special Categories: rules for children's, dietary, and sports nutrition, dietary supplements, and mineral waters; fortification is allowed with the approval of the Ministry of Health.
State Control: inspections, monitoring, and state audits of safety management systems that affect risk profiles and inspection frequency, without the imposition of penalties.
Laboratory Testing: mandatory in accredited laboratories; costs are covered from the budget during inspections, while the subject pays for confirming the elimination of violations.
Information: upon detecting non-compliance, subjects and authorized bodies are required to promptly inform the public, and intergovernmental information exchange is provided.

On Ensuring Food Safety in the Kyrgyz Republic
This Law establishes the legal and organizational foundations for ensuring food safety in the territory of the Kyrgyz Republic.
Chapter 1. General Provisions
Article 1. Definitions
The following terms are used in this Law:
1) food safety - a state in which there is no risk associated with harmful effects on humans and future generations;
2) state audit of food safety management systems - a form of control designed to verify compliance of the subject's activities with standards and obligations regarding safety systems;
3) state control over compliance with technical regulations - activities of bodies checking compliance with product requirements by legal and natural persons;
4) state monitoring - a form of control that includes the collection and analysis of information about the safety of food products and raw materials;
5) risk information - the exchange of information about risks and measures to manage them among all stakeholders;
6) integrated approach to ensuring food safety - comprehensive use of various methods and standards to minimize risks;
7) Animal Health Code - international standards for the health of terrestrial animals, updated by the World Organization for Animal Health;
8) "Codex Alimentarius" Commission - an international body for food standards established to protect consumer health;
9) good hygiene practice - creating conditions that eliminate the possibility of product contamination;
10) good agricultural practice - conditions for the safe production of agricultural products;
11) unprocessed food products - animal products that have not undergone processing;
12) primary production - the stage that includes the cultivation of plants and animals;
13) food products - products intended for human consumption;
14) specialized food products - products with specific nutritional properties for therapeutic diets;
15) food products for preventive nutrition - products that alter the content of substances to correct metabolism;
16) food products for children's nutrition - products that meet the physiological needs of children;
17) home-produced food products - products obtained in home conditions;
18) new type of food products - products that have not been previously used in the territory of the Customs Union;
19) food raw materials - raw materials used in the production of food products;
20) traceability - the ability to document the safety of products at all stages;
21) risk assessment - the process of identifying and evaluating the likelihood of threats;
22) subject - a legal or natural person engaged in the production or circulation of food products;
23) destruction of food products - rendering them in a state that excludes use;
24) disposal of food products - using products for purposes other than intended;
25) fortification - the process of adding micronutrients to products to enhance their value.
Article 2. Scope of the Law
1. The Law applies to food products produced and imported into Kyrgyzstan, as well as to all processes related to their circulation.
2. The Law also applies to materials that come into contact with food products and animal feed.
Article 3. Laws on Food Safety
1. The legislation of Kyrgyzstan on food safety is based on the Constitution, this Law, and international treaties of which the Republic is a party.
2. In case of contradictions between international treaties and this Law, the norms of the international treaty shall apply.
Article 4. Principles of Ensuring Safety
Ensuring food safety is carried out according to the principles of prioritizing human health, preventing harmful effects, scientific justification, transparency, and accountability of subjects for product safety.
Article 5. State Regulation
1. The goals of state regulation include protecting health, product competitiveness, and developing entrepreneurship.
2. Regulation is carried out through the development of policies, regulatory acts, and scientific research in the field of safety.
Article 6. Food Safety System
1. The safety system includes measures to prevent health risks.
2. The system's tools include risk analysis and traceability systems.
Article 7. Risk Analysis
1. Safety measures are based on risk analysis, aimed at identifying threats.
2. The analysis includes risk assessment and management, as well as information about them.
Article 8. Traceability
1. Traceability is ensured at all stages to prevent dangerous products from entering the market.
2. Subjects must have systems for identifying suppliers and buyers.
3. All products and subjects are registered in the state system with unique numbers.
Article 9. Conformity Assessment
1. Conformity assessment of products is carried out through registration and examination.
2. Production processes are subject to control assessment.
3. Assessment is conducted before the release of products to the market.
Article 10. Product Withdrawal
Products that do not meet the requirements are subject to recall or withdrawal.
Article 11. Information
Subjects are required to immediately inform about detected non-compliances.
Authorized bodies are also required to inform the public.
Article 12. Emergencies
In the event of infectious diseases, authorities take measures to restrict.
Chapter 2. Safety Requirements for Products
Article 13. Safety of Primary Production
Primary production must be safe for health.
Article 14. Safety in Production
The raw materials used must meet safety requirements.
A safety management system must be implemented.
Article 15. Packaging and Labeling
Products must be safely packaged and labeled according to requirements.
Article 16. Storage and Transportation
Storage must ensure the safety of products.
Article 17. Sale
The sale of products must meet safety requirements.
Article 18. Drinking Water
Drinking water must meet safety requirements.
Article 19. Equipment and Materials
All materials used must meet safety standards.
Article 20. Disposal
Non-compliant products must be disposed of according to established procedures.
Article 21. Employee Responsibilities
Employees must undergo medical examinations and training.
Article 22. Special Products
Specialized products must meet the needs of specific groups.
Article 23. Fortification
Products may be fortified with the approval of the Ministry of Health.
Chapter 3. Control Authority System
Article 24. Control Authorities
The system includes the Cabinet and authorized bodies.
Article 25. Control and Supervision
State control is carried out at all stages of production.
Article 26. Inspections
Inspections are conducted within established timeframes and procedures.
Article 27. Inspections at Primary Production
Subjects engaged in primary production are inspected.
Article 28. Inspections at the Sale Stage
Products sold at retail points are inspected.
Article 29. State Monitoring
Monitoring is conducted to determine the direction of state policy.
Results are used to assess risks and optimize control.
Article 30. State Audit
Management system audits are conducted upon the subject's request.
Article 31. Sample Collection
Samples are collected in established volumes.
Article 32. Laboratory Testing
Testing is conducted in accredited laboratories.
The budget covers testing costs during inspections.
Chapter 5. Rights and Obligations of Subjects
Article 33. Rights and Obligations
Subjects are required to comply with the Law's requirements and have the right to information about control.
Chapter 6. Final Provisions
Article 34. Responsibility
Persons violating the law are liable according to the Code of Offenses.
Article 35. Entry into Force
The Law enters into force 12 months after publication.
The Cabinet must ensure the adoption of necessary regulatory acts.
