According to the Constitution, every citizen has the right to freedom of peaceful assembly, and no one can be forced to participate in such events. To organize a peaceful assembly, it is necessary to notify state authorities or local governments.Samakov adds: "However, this right, related to freedom of speech, can sometimes provoke protests that disturb the peace of citizens. The freedom to assemble must take into account the rights of those who do not participate in the events. The state is obliged to ensure the safety of all citizens, including those who do not participate in rallies, and guarantee their rights to life and the inviolability of property."
According to the Ministry of Internal Affairs, from 2020 to 2023, there were 3,740 peaceful actions held in the country, including 1,727 in Bishkek. Additional law enforcement forces were involved to ensure public order at the rallies.
This highlights the need to establish designated areas for holding actions and their movement routes in advance.The deputy also points out that under current legislation, state and local authorities cannot restrict the time and place of peaceful assemblies.
In Samakov's opinion, the ability to designate places and routes for rallies will help avoid social conflicts and protect legally protected values, as well as contribute to the protection of citizens' rights and the safety of society.
