During the monitoring of social networks and news sites, the Working Group discovered publications indicating violations in the pre-election campaigning.
According to the first part of Article 23 of the Constitutional Law "On the Elections of the President of the Kyrgyz Republic and Deputies of the Jogorku Kenesh," the period of pre-election campaigning starts from the moment the registration of candidates is completed and ends 24 hours before the voting begins.
The identified violations include:
— Posts on Bakmurat Toktogulov's Facebook page that violate the conditions of pre-election campaigning and contain information discrediting candidates. According to paragraph 4 of part 10 of Article 22 of the Constitutional Law, such publications can be interpreted as pre-election campaigning;
— Posts on the Facebook pages of Aibek Tenizbay, Mirlan Duyshonbaev, and Nurgazy Anarkulov that also violate pre-election rules;
— Publications about the candidate from electoral district No. 18, Khandjeze Karim Lemzarovich, on Facebook that do not meet the requirements of pre-election campaigning;
— Posts about the candidate from district No. 23, Kasanov Kanat Zerlikovich, on Aibek Tenizbay's page that violate campaigning rules.
Taking into account the recommendations of the Working Group and guided by Articles 3, 4, and 8 of the Constitutional Law of the Kyrgyz Republic "On the Central Commission for Elections and Referendums," as well as Articles 65, 455, and paragraph 3 of part 1 of Article 451 of the Offenses Code, the Central Election Commission sent the materials on the specified cases to the authorized person to address the issue of holding the relevant individuals accountable in accordance with Article 65 of the Offenses Code.
Based on the above, considering the decision of the Working Group and guided by the Constitutional Law of the Kyrgyz Republic "On the Central Commission for Elections and Referendums," as well as Articles 65 and 66 of the Kyrgyz Republic Code on Administrative Offenses, the following decision was made:
— Fines of 7,500 (seven thousand five hundred) and 12,000 (twelve thousand) soms were imposed on Bakmurat Toktogulov for violations of pre-election campaigning and the dissemination of false information about candidates;
— A fine of 7,500 (seven thousand five hundred) soms was imposed on Aibek Tenizbay, Mirlan Duyshonbaev, Nurgazy Anarkulov, Karima Khandjeze, and Kanat Kasanov for violations of the conditions of pre-election campaigning.
The Central Election Commission of the Kyrgyz Republic reminds all participants in the electoral process, including candidates, government officials, and the media, of the necessity to strictly adhere to the legislation during pre-election campaigning.
