
The President of the Kyrgyz Republic, Sadyr Japarov, has approved a new Law "On Amendments to the Law of the Kyrgyz Republic on Public Procurement." This document was adopted by the Jogorku Kenesh on January 22, 2026.
The main goal of the amendments is to increase the efficiency and rationality of the use of budgetary funds at both the national and local levels when carrying out the procurement of goods, works, and services.
According to the new law, procurements related to the organization of international events at the state level involving the president, the speaker of the Jogorku Kenesh, the head of the cabinet of ministers, as well as visits by foreign leaders and delegations, are not subject to the Law on Public Procurement. These procurements will be carried out through the conclusion of civil law contracts between the customer and the contractor in accordance with the civil legislation of the country.
An important innovation is the introduction of the concept of "state assignment." This assignment represents an order to legal entities in which the state participates in the authorized capital, for the execution of priority tasks aimed at socio-economic stability and cultural development. Procurements within the framework of such assignments are also not regulated by the Law of the Kyrgyz Republic on Public Procurement and will be carried out through the conclusion of civil law contracts, specifying performance indicators.
The law is aimed at quickly resolving issues related to procurements in certain sectors funded by budgetary resources. It is important to emphasize that the state customer and the contractor of the state assignment are responsible for the targeted and effective use of the allocated budgetary funds in the process of executing the state assignment.
