The Government of Mongolia is Preparing to Revise Family Legislation

At the meeting held on October 29, 2025, the Cabinet of Mongolia decided to submit an updated version of the Family Law to the Great State Khural.

The current version of the Family Law requires revision, as it does not align with the main provisions of the Civil Code adopted in 2002. Due to identified discrepancies and the inability to reflect the modern realities of family relationships, the existing law does not provide sufficient protection for the rights of children and other family members. Therefore, the new version aims to harmonize family legislation with international standards, regulate new forms of relationships, and eliminate legal duplications and shortcomings.

The Family Law is a key element regulating private law relations in the country. The last changes to the current version were made in 1999, and since then it has not undergone significant changes. Although eight amendments have been made over the past 26 years, they mainly concerned the revision of other laws and did not address current issues of family relationships. As a result, the existing legislation does not fully reflect the changing dynamics of family relationships in modern society.

Since the adoption of the law, the number of cases related to marriage, divorce, child rights, and the protection of legal interests has significantly increased. However, the legal framework does not take into account all the consequences of these changes. According to the introduction to the draft law, effective resolution of family disputes and protection of family members' rights are becoming increasingly relevant. In 2024, the courts of Mongolia reviewed 73,727 civil cases, of which 3,538 were related to family law, accounting for about 10.1% of the total number of civil cases over the past five years.
