On October 22, the Constitutional Court issued a ruling stating that the session of the Great State Khural violated the Constitution due to the use of an incorrect "proposal formula" when dismissing Zandanshatar Gombojav from the position of Prime Minister. Additionally, it was found that Bulgan Tuya Khurelbaatar, who holds the position of Deputy Speaker of Parliament and presided over this session, also violated the Constitution. As a result, the government continues its work in the usual manner, based on this ruling of the Constitutional Court.
After Amarbayasgalan Dashzevge voluntarily left the position of Speaker of Parliament, his duties are now performed by Deputy Speaker Bulgan Tuya Khurelbaatar. However, there are rumors that Parliament may soon discuss the issue of her removal from deputy powers.
Democratic Party member and Deputy Speaker of Parliament Purevdorj Bukhchuluun stated in an interview that "we cannot ignore the Constitution and evade responsibility. Therefore, many in our faction insist that Bulgan Tuya should be deprived of her deputy mandate."
Thus, the Democratic Party faction intends to be the first to raise this issue. Moreover, political circles are discussing the possibility that Bulgan Tuya may suspend her powers voluntarily.
According to Article 9.1.4 of the Law on Parliament, if the Great State Khural decides that the Constitutional Court of Mongolia has confirmed the grounds for the recall of a member in accordance with Article 66, Part 2, Clause 4 of the Constitution of Mongolia, and Article 9.3 of the Law states that the Constitutional Court has concluded that a member has violated the Constitution, the Great State Khural must discuss and make a decision on the recall of that member.
