A fierce struggle for power has erupted within the Mongolian People's Party.
For several days, active debates were taking place in the party through press releases and meetings regarding the election of a leader. The Constitutional Court of Mongolia played an important role in this matter, ruling that the parliamentary decision to dismiss Prime Minister Zandanshatar Gombojav contradicts the country's Constitution.
According to the court's conclusion, this decision violates Articles 1.2, 43.1, and 70.1 of the Constitution of Mongolia, which pertain to the fundamental tasks of state activity and the functioning of the Great State Khural.
The country's President Khurelsukh Ukhna also vetoed this decision, pointing out procedural violations during the voting.
The initiators of the Prime Minister's dismissal, the chairman of the committee on state development Sandag-Ochir Tsend and vice-speaker Bulgan tuyaa Khurelbaatar, may soon lose their positions or even mandates if their colleagues bring this issue to the agenda of the next session of the Khural.
Nevertheless, Zandanshatar managed to achieve victory and is now appointing his supporters to key positions in the government.
The Prime Minister presented MP Enkhbayar for the position of Minister of Justice and Internal Affairs.
Zandanshatar Gombojav, Prime Minister of Mongolia, presented his candidate, MP Enkhbayar Battumur, to the Great State Khural for the position of Minister of Justice and Internal Affairs in accordance with Article 39, Section 4 of the Constitution of Mongolia and Article 23, Article 1.2 of the Law on Government.
"The Prime Minister enjoys special powers granted by the Constitution, and I am confident that the government, acting in full composition, will successfully fulfill its tasks with the support of the people and the parliament," noted Zandanshatar.
According to Article 39, Section 4 of the Constitution of Mongolia, "a member of the Government is appointed, dismissed, and resigns upon the proposal to the Great State Khural and the President. A member of the Government takes an oath before the Great State Khural." Thus, the appointment of Enkhbayar Battumur will take effect after he takes an oath before the Great State Khural.
