As reported by Felix Kulov, Kyrgyzstan is expecting two key political and legal events:
Kamchybek Tashiev, Deputy Chairman of the Cabinet and Head of the GKNB, noted that the city of Manas is planned to be transferred from regional to republican status. This change is only possible through amendments to the Constitution via a nationwide referendum. Currently, Bishkek and Osh have the status of cities of republican significance.
It is proposed to consider additional questions for the upcoming referendum, aside from the aforementioned:
1. The introduction of the death penalty only for particularly serious crimes, such as murders that pose a threat to the lives of many people, or committed as part of a criminal community. Currently, life imprisonment is provided for such crimes.
2. The enshrinement in the Constitution of the mandatory consideration of cases with the participation of jurors and multi-level appeals. It is also proposed to create a provision regarding the president's right to suspend the execution of a sentence in the event of new circumstances. The procedure for executing death sentences should be regulated by a separate law.
3. The question of how the president, as the guarantor of the Constitution, exercises his powers should also be put to a referendum. This will allow transforming the declarative nature of this norm into a specific legal instrument.
4. The introduction of provisions on the digital economy and national blockchain platform into the Constitution, which will contribute to the transparency of state expenditures and the fight against corruption, based on the examples of Estonia and the UAE.
The initiatives presented in points 3 and 4 may be considered by the parliament at the proposal of the president or with the support of two-thirds of the deputies of the Jogorku Kenesh.
The issues of the death penalty and the status of the city of Manas should be resolved exclusively through a nationwide referendum.
It is expected that other proposals may emerge, given the growing political activity of citizens.
PS. To enhance the significance of the city named after the great Manas, it would be advisable to grant it the status of a judicial capital, relocating the Supreme and Constitutional Courts, as well as several ministries and agencies there. This will be especially relevant considering the future construction of the China-Kyrgyzstan-Uzbekistan railway, which will make the city of Manas a transport and logistics center.
