The editorial office of Kaktus.media previously reported on the request of Oksana Bukhantsova: the woman lost her daughter and is trying to regain custody of her grandson Artem, who remains in Russia with his stepfather. Dmitry, the boy's stepfather, contacted the editorial office to explain why he does not want Artem to live with his grandmother in Kyrgyzstan.

According to Dmitry, in December 2024, he formalized permanent guardianship over Artem, as he was unable to adopt him due to claims from the grandmother.

“Artemiy is a citizen of the Kyrgyz Republic. I commit to preserving his citizenship until he reaches adulthood, after which he will make his own decision. I registered these obligations at the consulate of the Kyrgyz Republic in Novosibirsk. Additionally, the child is on consular registration in Yekaterinburg. I am responsible for his upbringing, and my mother helps me,” Dmitry noted.

So why is Dmitry against transferring the boy to his grandmother? He has been living with his wife Darya and Artemiy since 2018. Since then, according to him, the boy perceives him as a father.

In Dmitry's objection to Bukhantsova's application for guardianship, it is stated that Artemiy has no emotional attachment to his grandmother, as they have never lived together. The document notes that Dmitry has raised the boy from an early age and has effectively replaced his father, fulfilling all parental functions. He also emphasizes that the stepfather is an important figure in the child's life. Artem continues to live with him even after his mother's death, maintaining a familiar lifestyle and environment.

“Artemiy has a very strong relationship with his younger brother,” the document states.

In addition, Dmitry points out that the biological grandmother has a criminal record that limits her parental rights regarding her younger daughter, as confirmed by a document from the Ministry of Labor and Social Protection of Kyrgyzstan dated December 2024.

Dmitry also states that the grandmother often accuses him of having financial interests regarding guardianship over Artemiy. “I receive 16,000 rubles a month for the child, which is enough for his maintenance. Every year, I provide reports and receipts to the guardianship authorities, and their employees periodically check the conditions in which we live,” he added.

According to him, he formalized guardianship by order of the Novosibirsk city administration in December 2024, and the Ministry of Labor, Social Protection, and Migration of the Kyrgyz Republic consented to this. “The court, which limited the grandmother's parental rights, confirmed that it is in the child's best interest for him to live with Dmitry's family,” the ministry's document states.

Dmitry's objection also emphasizes that guardianship has already been established, and the order from the Novosibirsk city administration appointing him as Artemiy's guardian has not been revoked and remains valid.

Lawyer Indira Sautova, representing the interests of the grandmother, explained that Oksana Bukhantsova was limited in parental rights only regarding her younger daughter according to a court decision in 2016 for a period of six months.

“These restrictions were absurd and were initiated by the mother-in-law. They were lifted back in 2016, and now Bukhantsova's younger daughter is already of legal age. This document from the Ministry of Labor and Social Protection has been appealed. If the grandmother had been limited in her rights, she would not have been placed on the guardianship waiting list,” she added.

Indira Sautova also noted that only the court can establish guardianship.
