Law on Silence: Housing Committees May Be Allowed to Draft Noise Protocols

The Ministry of Internal Affairs has prepared amendments to the Code of Offenses, as well as to the laws "On the Basics of Crime Prevention" and "On Silence." Deputies discussed this draft law at a meeting of the committee of the Jogorku Kenesh, which deals with issues of law and order, the judicial system, and the fight against crime.

According to Deputy Minister of Internal Affairs Oktobur Urmambetov, previously, the control over compliance with the silence law was the responsibility of the Ministry of Health, specifically its Department of Health Prevention and Sanitary-Epidemiological Supervision.

It is now proposed that the right to respond to citizens' complaints about noise and to draw up protocols for offenses be transferred to the internal affairs bodies and local self-government.

In addition, as the deputy minister noted, managers of apartment buildings will also be given the authority to conduct preventive measures and draw up acts of violations, which will be sent to government bodies.

In response to deputies' questions, Urmambetov reported that fines for noise are already stipulated in the current legislation: 10,000 soms for individuals and 28,000 soms for legal entities. If necessary, the issue of increasing these fines can be considered.

The draft law also stipulates that during the New Year celebrations, from 10:00 PM on December 31 to 3:00 AM on January 1, the silence norms can be disregarded.

Ministry of Health representative Ryspek Sydygaliev reported that noise level control is carried out using special equipment.

“We have three types of sound level meters at our disposal. We need another 16 units of equipment. We received 62 complaints about noise from exhaust ventilation and 79 complaints about noise from musical instruments and construction work. As a result, 30 protocols were drawn up, and the total amount of imposed fines was 604,000 soms,” he added.

The deputy head of the Ministry of Internal Affairs also noted that last year, 23 establishments, including cafes and nightclubs, were fined for violating the silence law.

As a result of the discussion, committee members approved the draft law in the first reading.

The "On Silence" law was signed in December 2024 and was initiated by deputy Dastan Bekeshev with the aim of protecting citizens' health from excessive sound pressure and noise exceeding permissible norms.
