According to the adopted resolution, which will come into effect ten days after its publication on February 19, 2026, citizens must take into account the new requirements.
Mandatory electronic payment for notarial services
According to the new regulations, all state fees for notarial actions must be paid on the day they are performed through a special payment platform integrated into the Unified Information System of Notaries (UISN).Payment will be recorded in the system, confirming its completion. Additionally, the text of the notarial certificate must now be generated exclusively through the UISN.
Personal presence for formalizing certain agreements
According to the new rules, personal presence of the parties is required for the conclusion of several important agreements. Formalizing these documents through authorized representatives is not allowed.This applies to the following agreements:
- marriage contract;
- surrogacy agreement;
- agreement on transferring a child to a foster family;
- lifelong maintenance agreement;
- perpetual rent agreement;
- alimony agreement;
- agreement on parental rights.
Changes in the procedure for children traveling abroad
The rules for formalizing consent for minors to leave the country have also been clarified.Now, the consent of parents, guardians, or adoptive parents for a child to travel unaccompanied, as well as for permanent residence abroad with one of the parents or guardians, will be formalized only for a specified period.
New requirements for notarial orders
The resolution also clarifies the requirements for issuing notarial orders depending on the grounds for collection. This concerns:- notarized transactions;
- transactions in simple written form;
- protests of promissory notes;
- alimony for minor children (in the absence of a dispute over paternity or maternity);
- mandatory payments (excluding taxes and insurance contributions);
- unpaid wages.
Notification of debtors via messengers
The rules for notifying debtors about the issuance of a notarial order have been changed.Now, the notary must send a copy of the order no later than the next day after its issuance, and this can be done:
- by mail with acknowledgment of receipt;
- by email in PDF format;
- through messengers WhatsApp, Viber, and Telegram;
- in direct messages.
Continuation of the digitalization of notaries
The Ministry of Justice noted that earlier, digital notarial services had been implemented in the country, including:- remote notarial actions for citizens of Kyrgyzstan abroad through the "Electronic Notary" system;
- remote execution of certain notarial actions;
- pilot implementation of the "Electronic Apostille" system with a full online cycle;
- increased qualification requirements for private notaries in inheritance cases;
- expansion of international cooperation in notarial activities.
