Fines Imposed on a Candidate for Deputy of the City Duma and Citizens for Violating Election Campaign Conditions and Insulting the Honor and Dignity of the Candidate

The Central Election Commission held a meeting on November 24, during which issues related to violations of election campaigning by candidates for the Jogorku Kenesh and citizens, as well as cases of insult to the honor and dignity of candidates, were discussed. Early elections to the parliament are scheduled for November 30.

The working group of the CEC, which monitors campaigning and informs voters, identified cases of the dissemination of prohibited information on social media related to candidates such as Janarbek Akayev (district No. 8), Ulan Bakasov (district No. 30), and Erkeaiym Seitkazieva (district No. 25).

On the Facebook page "Janar Akaev," photos and videos violating election rules were posted. On November 18, an election campaign event involving J. Akayev was held near polling station No. 5139, which contradicts the legal norms prohibiting the placement of campaign materials in the premises of election commissions and at polling stations.

Violations were also recorded concerning E. Seitkazieva, when Instagram user A. Yakhizov ("iakhizovanvar") shared materials that did not meet the legal requirements for candidates. Notably, from the moment the elections were announced, bribing voters and distributing money or gifts is prohibited. During the working group meeting, A. Yakhizov explained that he was unaware of the violation and had entered into an agreement with the candidate to conduct campaigning on social media.

As for U. Bakasov, the dissemination of prohibited information was carried out by Facebook user "Adilet Kadyrakunov." He was fined 75 calculated indicators. At the working group meeting, he stated that he had not managed to delete the controversial posts. According to Article 61 of the Code of Offenses, fines are provided for non-compliance with the decisions and requirements of the CEC.

The CEC also received materials from the Kadamjai District Department of Internal Affairs concerning N. Azhibaeva, who disseminated information discrediting the honor of candidate Amanova Burun Kushbekovna from district No. 2. In the WhatsApp messenger group "Domkomy Kadamjai-Suu channels," N. Azhibaeva published knowingly false information about the candidate. According to the law, such actions entail criminal or other liability.

The working group proposed that the CEC impose an administrative fine of 75 calculated indicators (7500 soms) on candidate J. Akayev and citizens A. Kadyra Kunov and A. Yakhizov. For N. Azhibaeva, a fine of 125 calculated indicators was recommended, according to Article 66 of the Code of Offenses.

The CEC also considered a complaint from T. Alkhodzhoev, representative of candidate Karybekov Ilim Mayrambekovich from district No. 23. It mentioned obstacles to conducting campaign events. In particular, in the Pervomaisky district of Bishkek, campaigners were denied access to the territory of one of the apartment buildings, claiming that this building supported candidate Umbetaly Kydyraliev. The applicant believed that this created unequal conditions for all candidates.

However, the working group, after analyzing the statement, decided to deny T. Alkhodzhoev, finding insufficient grounds to confirm his claims of obstruction to campaigning.

As a result, based on the recommendations of the working group, the CEC decided to impose administrative fines on J. Akayev, A. Kadyra Kunov, and A. Yakhizov in the amount of 75 calculated indicators, and on N. Azhibaeva — 125 calculated indicators. The demands of the authorized representative I. Karybekov by T. Alkhodzhoev remained unsatisfied.
