According to Aysalkyn Karabaeva, the plot on which the restaurant is located was allocated for construction back on January 24, 1989, by a decision of the Executive Committee of the City Council of People's Deputies of Osh. The size of the allocated land is 0.30 hectares. All necessary legal documents for this plot, which was originally intended for the construction of a multi-story hotel complex, are recorded in archival documents. However, construction was not completed due to the collapse of the Soviet Union.
According to the lawyer, on March 9, 1995, OJSC "Osh-jol" purchased this plot from the State Property Fund for 178,893 soms, as confirmed by sales contract No. 926 and ownership certificate No. 001085. At that time, there were no clear state acts or technical passports for managing municipal property. Later, on June 26, 2000, the joint-stock company sold the plot to a citizen S.A. for 311,400 soms, who then resold it to S.M.
The lawyer noted that on August 20, 2003, the Osh city administration signed contract No. 1287, and on November 6, 2003, issued a state act according to resolution No. 1259. On May 26, 2011, private ownership rights were formalized. "Based on data from the 'Cadastre,' as of June 21, 2024, the building now belongs to one of the commercial banks," Karabaeva added.
Zamir Adigeneev also commented on the situation, noting that in 2023, the city administration made a decision to transfer 8 hundredths of land to the balance. "Two years have passed, and if we divide the amount of 14 million soms by two years, it comes out to 7 million soms per year. Even if we assume that these 8 hundredths are municipal land, it is unclear on what basis such an amount was calculated. Before making such statements, the city administration should have notified the owner of the restaurant 'Meerim,' but no notifications were received. As my colleague has already mentioned, the owner of the establishment is a commercial bank. If the bank is indeed the legal owner, then on what grounds do the former deputies claim to be the owners when they have no legal basis for it? This misleads both the public and the mayor, Jenishbek Toktorbaev," emphasized Adigeneev.
He also reminded about Presidential Decree No. 3 dated January 29, 2021, concerning the protection of the rights of entrepreneurs and investors, noting that the law "On the Protection of Entrepreneurs" must be observed.
Previously, the city administration reported that the restaurant "Meerim" has a debt of 14 million soms for the lease of municipal land and commercial premises, and former deputies Ravshan Rysbaev and Rustam Mamanov were named as the owners of the establishment.
Entrepreneur Rustam Mamanov was a deputy of the Jogorku Kenesh from 2000 to 2005. His younger brother, Ravshanbek Rysbaev, also has experience in politics, having held positions as a deputy of the Osh City Kenesh and Deputy Minister for Emergency Situations.
