He pointed out that this court ruling raises many questions in the context of procedural and substantive law. According to him, civil procedural legislation does not allow for the recognition of individuals' activities as extremist within the framework of special proceedings. Thus, the court effectively carried out a criminal-legal assessment of citizens' actions, which exceeds its jurisdiction. Moreover, the ruling lacks specific references to the materials deemed extremist, as well as the criteria by which this was determined, which violates the principles of legal certainty and fair trial.
Alagushiev also emphasized that such an approach could lead to absurd consequences. For example, interviews with officials, reports from state events, as well as materials dedicated to medicine or education could fall under the scope of this ruling.
In his opinion, this creates a danger of excessive restriction of freedom of speech, which contradicts the Constitution and international obligations of Kyrgyzstan, including Article 19 of the ICCPR.
Alagushiev also noted that, considering the identified procedural violations, there are ample grounds for cassational annulment of the decision of the October District Court.
It should be recalled that on October 27, 2025, the October District Court of Bishkek recognized the informational materials of the media projects Temirov Live and Kloop.kg (the "Kloop Media" Foundation), as well as the activities of T. B. M. (Bolot Temirov) and T. R. R. (Rinat Tukhvatshin), as extremist.
Furthermore, the court prohibited the activities of internet resources and pages of the media projects Temirov Live, Kloop.kg, and "Ait ait dese" under the control of T. B. M. and T. R. R., as stated in the official announcement.
The enforcement of this decision has been entrusted to the Service for Regulation and Supervision in the Field of Communications under the Ministry of Digital Development and Innovative Technologies of the Kyrgyz Republic.
