“From the standpoint of procedural and substantive law, this decision appears questionable. Civil legislation does not provide for the possibility of recognizing the extremist activities of individuals within the framework of special proceedings. The court essentially made a criminal-legal assessment of the actions of citizens, which exceeds its competence,” he noted.
Alagushiev emphasized that the decision lacks clarity regarding the specific materials that were recognized as extremist and the criteria by which this was done. This, according to him, contradicts the principles of legal certainty and fair trial.
In the expert's opinion, such an approach could lead to unexpected consequences: materials such as interviews with officials or reports from events related to medicine and education could be classified as extremist.
“This approach is not only absurd but also threatens freedom of speech, which is protected by the Constitution and international obligations of Kyrgyzstan, including Article 19 of the ICCPR,” he added.
Alagushiev also reminded that given the identified procedural violations, there are grounds for cassation cancellation of the decision of the October District Court.
Recall that on October 27, 2025, the October District Court of Bishkek recognized the materials of the media projects Temirov Live, Kloop.kg (NGO "Kloop Media"), and "Ait ait dese," as well as the activities of T. B. M. (Bolot Temirov) and T. R. R. (Rinat Tukhvatshin), as extremist.
In addition, the court prohibited the operation of the internet resources and pages of the mentioned media projects, which operate under the guidance or with the participation of T. B. M. and T. R. R., as stated in the announcement.
The enforcement of this decision is entrusted to the Service for Regulation and Supervision in the Field of Communications under the Ministry of Digital Development and Innovative Technologies of Kyrgyzstan.
