Tattuu Bububu Ergeshbaeva, a lawyer and activist, has appealed to the Constitutional Court of the Kyrgyz Republic to clarify the nuances of the presidential term limits in accordance with the new Constitution. She posted the relevant information on her social media.
Ergeshbaeva requested clarification from the court on Articles 67 and 69 (part two) of the Constitution, which pertain to the calculation of the term of the current president. This appeal arose from legal uncertainty caused by discrepancies between the text of the Constitution and the actual practices established after the reforms of 2021.
According to the lawyer, the Constitution adopted on May 5, 2021, establishes a clear five-year term for the presidency, leaving no room for exceptions, alternative methods of calculation, or extensions of the mandate.
However, following the events of 2020-2021 and transitional regulations, a practice emerged in which the presidential term is interpreted as six years. This approach is not reflected in the Constitution and lacks direct normative support, leading to a conflict between constitutional norms and their practical application.
As Ergeshbaeva emphasizes, the absence of an official interpretation and a unified understanding of the start of the presidential term creates a risk of arbitrary expansion of constitutional norms, which could undermine the principles of the rule of law, legal certainty, and popular sovereignty.
She also noted that only authorized state bodies have the right to request official clarifications. In this regard, the lawyer is awaiting a response.
In addition, the activist plans to send a request to the Jogorku Kenesh asking for the parliament to initiate a motion to obtain an official interpretation of the constitutional norms and to eliminate existing ambiguities.
It is worth reminding that earlier, a group of 75 politicians and scholars sent an appeal to President Sadyr Japarov and the speaker of the Jogorku Kenesh, Nurlanbek Turgunbek uulu, requesting to consider the possibility of holding early presidential elections.
