The Ministry of Health proposes to expand access to unregistered drugs for all medical institutions

The Ministry of Health has presented a draft resolution of the Cabinet of Ministers for public discussion, which concerns amendments to the existing resolution "On the Approval of the Procedure for Compiling and the Criteria for Exclusion and Inclusion of Medicinal Products and Medical Devices in the Special List of Medicinal Products and Medical Devices Temporarily Permitted for Import and Medical Use Without Registration" dated August 23, 2025, No. 522.

The main objective of this document is to ensure access to unregistered drugs and medical devices for all medical organizations, regardless of their ownership structure.

Currently, according to the established procedure, only state healthcare institutions can submit applications for the inclusion of drugs in the special list, which limits access for municipal and private medical institutions to such medicines and devices.

The justification for the project emphasizes that the right to medical assistance and health protection should be accessible to all citizens, regardless of the ownership form of the medical organization. The current restrictions create inequality among patients.

The situation is complicated when a patient begins treatment in one medical organization and completes it in another. Restrictions on access to medicines and devices can disrupt the continuity of therapy, especially in cases of rare diseases or oncology, which is also noted in the project.

The Ministry of Health refers to Article 43 of the Constitution, which obliges the state to create conditions for medical care for everyone and to take measures to develop all forms of healthcare—state, municipal, and private.
