According to the draft of the new Constitution, which will be put to a referendum on March 15, the parliament of Kazakhstan, formed in accordance with the current Constitution, will cease its powers on July 1, 2026. This provision is stated in Article 95 of the draft of the new Fundamental Law.

As indicated in the draft Constitution, the President of the Republic of Kazakhstan must announce elections to the Kurultai within a month and hold them within two months after the new Constitution comes into force.

According to Article 94, the new Constitution, which will be adopted at the republican referendum, will come into force on July 1, 2026. From that day, the current Constitution will lose its validity.

The date of the adoption of the new Constitution at the referendum will be marked as a state holiday — Constitution Day of the Republic of Kazakhstan.

In addition, within two months after the opening of the first session of the Kurultai of the first convocation, the President is required to appoint a Vice President with the approval of the deputies, as well as appoint the Chairman and judges of the Constitutional Court, members of the Central Election Commission, and the Supreme Audit Chamber. Until the new composition of the Constitutional Court is formed, the Chairman and judges, as well as the heads of the Central Election Commission and the Supreme Audit Chamber, appointed under the Constitution of August 30, 1995, will retain their positions.

Within two months from the date the new Constitution comes into force, the Chairman of the Supreme Court, the Chairman of the National Bank, the Prosecutor General, the Chairman of the National Security Committee, and the Chairman of the Supreme Judicial Council, as well as the Ombudsman, must also be appointed.

Judges of the Supreme Court, as well as judges of lower courts, deputies of maslikhats, and other officials elected or appointed according to the Constitution of August 30, 1995, will retain their powers until their status is changed in accordance with the Constitution and legislation.
