The deputy fears that the institution of private bailiffs may turn into a business

Deputy Ulukbek Uzakbaev from the Jogorku Kenesh expressed concerns that the new institution of private bailiffs could lead to the commercialization of state functions.

On February 24, during a meeting of the parliamentary committee on judicial and legal issues, a draft law concerning enforcement proceedings will be discussed, which proposes the introduction of private bailiffs with expanded powers.

According to the deputy, "this is a significant reform, but society is not sufficiently informed about it. The Prosecutor General's Office will receive many new powers, but there are also risks, aren't there?"

Deputy Prosecutor General Umutkan Konkubaeva noted that the establishment of the institution of private bailiffs is part of President Sadyr Japarov's decree.

She assured that "the introduction of this institution does not pose a danger. We studied the experience of neighboring countries, and such practices already exist. Citizens will be able to choose between private and state bailiffs, which will be in their interest."

Uzakbaev pointed out the wide range of functions that are being transferred to private bailiffs, including arrests and travel restrictions.

“A significant number of state functions are being transferred to private individuals. The draft law outlines the qualification requirements for private bailiffs. Nevertheless, I insist on stricter control to prevent it from turning into a commercial enterprise. It is important to consider that situations may arise where someone may become undesirable. The responsibility of private bailiffs needs to be tightened,” he added.

Konkubaeva agreed with the deputy's remarks.

“You are right, the control from the prosecutor's office will be strict. For example, in the hiring requirements, we established a minimum age of 25 years, while for public service it is usually 21 years. The control will be serious,” she assured.

The deputy also noted that this is the first case in history where such functions are being transferred to private companies.

Konkubaeva reminded that a similar practice had already taken place: last year, the Ministry of Justice transferred some powers to private notaries for handling order cases.

The deputy clarified: “However, notaries do not have the authority to freeze bank accounts?”

To which Konkubaeva responded that this is one of the functions of enforcement proceedings and assured that the control over the actions of private bailiffs will be strict.
