The initiator of this bill was the General Prosecutor's Office. The draft proposes the following key changes:
- the introduction of the institution of private bailiffs;
- strengthening penalties for alimony defaulters;
- the possibility of seizing funds and other assets held in the accounts of legal and physical persons, not only by the court but also by bailiffs or private executors, in accordance with the circumstances established by law;
- the recovery of funds and valuables from bank accounts can be carried out not only by courts but also by private bailiffs based on enforcement documents, according to the legislation;
- banks are obliged to provide bailiffs with information that constitutes banking secrecy, regarding enforcement documents containing claims for the recovery of funds.
He noted: "Information concerning banking secrecy should only be accessible by court decision."
In addition, the deputy expressed dissatisfaction with the norms allowing fines to be imposed on private bailiffs for violations in the field of enforcement proceedings.
According to Omurzakov, there is an impression that the text of the bill was prepared by different authors in state and official languages, as it contains significant technical errors.
Deputy General Prosecutor Umutkan Konkubaeva confirmed that all comments will be carefully studied.
