According to the city hall, the need to revise the regulatory framework in the field of land relations arose due to changes in the Land Code of the Kyrgyz Republic.
The existing rules established by the resolution of the Bishkek City Council dated January 14, 2020, No. 139, contain outdated provisions and references to previous editions of the code, making them irrelevant to modern realities and new approaches to regulating land purchases.
Moreover, an analysis of law enforcement practices revealed the need for additional guarantees for the fulfillment of obligations by lessees when purchasing plots.
As part of the new project, it is proposed:
- the mandatory presence of a pledge agreement to initiate the purchase process;
- the possibility of alternative purchase, which will allow transferring 10 percent of residential premises in the constructed buildings to municipal ownership;
- the development of a methodology for determining the purchase price of land;
- the optimization of inter-agency cooperation when processing applications for purchase, including the exclusion of unnecessary procedures, such as urban planning conclusions, when they are not needed.
It is expected that the introduction of these changes:
- will ensure the transparency of purchase procedures;
- will reduce the processing time for applications;
- will increase revenues to the budget of Bishkek;
- will enrich the municipal housing stock.
