Let us remind you that in 2025 a new Land Code was adopted, which classified garden and cottage plots as lands of populated areas designated for "residential construction." However, there have been no unified norms for their use until now, which has created disagreements and complicated the establishment of territorial boundaries, as well as the transfer of common-use facilities, increasing the risks of non-targeted land use.
The proposed draft will allow for a clear definition of the boundaries of such plots. This will be implemented through special commissions operating under local self-government bodies, based on decisions regarding the allocation of plots that were made before June 16, 1999.
Once the boundaries of common-use lands are established, they are planned to be transferred to the local authorities, while plots designated for transformer substations and power transmission lines will be handed over to the relevant energy organizations.
Additionally, the draft separately addresses the issue of ownerless plots. If the land has no registered owner and is free from third-party rights, it will be considered ownerless property in accordance with the norms of the Civil Code. These territories will become part of the residential areas of nearby populated places while retaining the names of gardening associations.
It is expected that the adoption of this document will lead to:
- the organization of urban planning documentation;
- increased efficiency in land use;
- the creation of favorable conditions for infrastructure development and improvement.
