It should be reminded that a new Land Code was adopted in 2025, which classified garden plots as lands of populated areas designated for "housing construction." However, there has not yet been a unified regulation for their use, which has caused confusion and complicated the process of determining the boundaries of plots, as well as the transfer of common property, thereby creating risks of misuse of these lands.
As part of the new project, it is proposed to establish a procedure for determining the boundaries of the specified territories. Commissions under local administrations will carry out this work based on decisions on land allocation made before June 16, 1999.
Once the boundaries are established, common land will be transferred to the management of local self-government bodies, and plots occupied by transformer substations and power lines will be transferred to the relevant energy organizations.
The issue of ownerless plots is also addressed in the project. Lands that do not have registered owners and are free from third-party rights will be considered as ownerless property in accordance with the norms of the Civil Code. At the same time, these territories will be effectively perceived as residential areas of the nearest populated places, retaining their former names of gardening associations.
The government is confident that the adoption of this document will allow:
- to streamline urban planning documentation;
- to increase the efficiency of land use;
- to create conditions for infrastructure development and improvement.
