According to the proposal, garden zones will be included within the boundaries of populated areas.
It is worth noting that previously, part of the garden lands had already been transferred to the category of land for populated areas for the purpose of "housing construction." However, it is necessary to approve new regulations that will govern the use of these plots, as well as clarify issues related to boundaries and ownership.
Officials emphasize that changing the land category will not affect citizens' private property rights to their plots.
The determination of the boundaries of garden areas that will be recognized as land in populated areas will be based on documents confirming the allocation of land for gardening or collective gardening, issued before June 16, 1999.
If the actual area of the territory exceeds that indicated in the old decisions, the excess will be transferred to the new category in accordance with the general procedure for land transformation.
In the absence of a unified plan for old garden territories, materials from the land inventory conducted from 1991 to 1998, prepared by the State Design Institute "Kyrgyzgiprozem," as well as information from agencies responsible for managing water and forest resources, and, if available, urban planning documentation and data from the Unified State Register of Real Estate Rights will be used.
Lands recognized as populated areas will be considered part of the nearest populated area, while the name of the gardening partnership or society will remain unchanged.
