The case was initiated due to a video published on October 22, 2025, on one of the Telegram channels, in which Bivol used profanity while making derogatory comments about representatives of various nationalities, including Kazakhs and Kyrgyz. The case was opened under Article 20.3.1 of the Code of Administrative Offenses of the Russian Federation, which pertains to inciting hatred or enmity, as well as humiliating human dignity.

Previously, criminal cases had been initiated against Ekaterina Bivol in Kyrgyzstan and Kazakhstan for similar offenses, and she was placed on an international wanted list in both countries.

Additionally, the court in St. Petersburg had previously recognized some of Bivol's statements about her ex-husband as false and damaging to his honor and dignity, ordering her to refute this information.
