The bill on the reform of homeowners' associations has been submitted for consideration by the Jogorku Kenesh.
One of the main innovations is the change in the procedure for forming an initiative group: now, only 10 percent of the total number of owners will be required to create it. This group is obliged to notify all property owners and to select a notary in advance who will certify the authenticity of the signatures of the participants in the founding meeting. This innovation is aimed at preventing falsifications and confirming the real participation of owners in the process.
The draft law also includes the establishment of a mandatory register of HOA members, which will contain information about property owners and the dates of their membership. This register will serve as the basis for checking the quorum at general meetings. Updated lists must be submitted to the registering authority annually.
Furthermore, it is planned to tighten the rules for decision-making: if the HOA includes owners of non-residential premises, general meetings must be held only in person. The notary will also be required to certify the signatures of all participants in such votes.
It is proposed to extend the term of office of the HOA board from two to three years, as well as to establish a rule that the powers of the current board cease only after the election of a new composition. This will prevent the occurrence of management gaps.
As the developers of the draft law assert, the proposed changes are aimed at eliminating abuses, protecting the rights of owners, and increasing the efficiency of managing apartment buildings. The document has already been published for public discussion.
