The Ministry of Natural Resources proposes to introduce liability for the circulation of environmentally harmful bulk coal.

The Ministry of Natural Resources, Ecology, and Technical Supervision has presented for public discussion a draft law "On Amendments to the Code of the Kyrgyz Republic on Offenses."

This draft law is developed to implement powers in the field of environmental protection control, as well as to enhance supervision in the areas of industrial safety, mining supervision, and subsurface resource protection. It is also intended to ensure prompt response to violations of environmental legislation.

According to the World Bank's report on air quality in Bishkek for 2023, the main sources of average annual concentrations of fine particulate matter PM2.5 in the capital are residential heating (29%) and transportation (27%). The use of low-quality fuel, including fine fractions of bulk coal, significantly worsens the air pollution situation.

The Cabinet of Ministers issued Resolution No. 639 on October 6, 2025, which prohibits the import, storage, sale, and use of bulk coal with a fraction of up to 13 mm. This type of fuel is recognized as one of the main factors contributing to air pollution, as its combustion leads to the formation of fine particulate matter, solid fractions, and harmful gases.

Currently, the Code on Offenses lacks an article that provides for liability for violating this prohibition. The introduction of such a provision is an important step towards ensuring compliance with Resolution No. 639 and strengthening control over the state of the atmospheric air.

Control over compliance with the prohibition, consideration of violations, and application of administrative measures will be carried out by the Environmental and Technical Supervision Service, which is part of the Ministry of Natural Resources, Ecology, and Technical Supervision.
