The Ministry of Health of the Kyrgyz Republic has proposed to the public to review the draft presidential decree concerning the temporary regulation of certain aspects of the circulation of potent substances in the country.

This document aims to implement new mechanisms for state control for a period of one year, which should help reduce the risks of illegal circulation and enhance public safety, especially among youth and children.

According to the draft, the authorities of the Cabinet of Ministers will be empowered to develop rules regarding the legal circulation of potent substances, including their production, processing, acquisition, storage, import, export, transportation, and mailing, as well as the necessary equipment for production.

The need for this decree arose in the context of the anticipated adoption of Law No. 56 in March 2025, which will amend a number of legislative acts of the Kyrgyz Republic aimed at combating the illegal circulation of drugs, psychotropic substances, and their precursors among youth. The new version of Article 293 of the Criminal Code will regulate the legal circulation of potent substances; however, the current legislation does not provide the government with clear powers to implement these norms.

In the context of the self-dissolution of the Jogorku Kenesh, the only option became the use of Article 311 of the Law "On Normative Legal Acts," which allows the president to temporarily regulate public relations for a period of up to one year.

The adoption of this decree will help ensure legal responsibility for violations of the rules regarding the circulation of potent substances, improve control procedures for legal entities, strengthen customs and border measures, and allow for monitoring of the new order before its incorporation into the main legislation.
