According to him, such a change violates the Council's working regulations and raises questions about the fairness of the process. In his appeal, he also emphasizes that the case materials lack clear evidence of bribery and corrupt actions, both on his part and on the part of other former judges — S. I. Branchaeva and Zh. Mambetaly.
Abakirov noted that the annulment of the 2016 verdict on "new circumstances" cannot serve as a basis for accusing him of rendering an unjust decision. He pointed out that the judicial panel acted in accordance with the law, based on the results of the examination and the statements of the victim, as well as the position of the state prosecutor, who himself petitioned for the reclassification of the charges.
Furthermore, he expressed concern about the potential politicization of the case, noting that he and other former judges had dealt with high-profile cases related to Sadyr Japarov and Kamchybek Tashiev.
In his appeal, Abakirov requests:
- to place the investigation under the personal control of the president;
- to release S. I. Branchaeva and Zh. Mambetaly from the measure of restraint related to imprisonment;
- to ensure the independence and objectivity of the investigation.
The initials of the former judges correspond to the names of S. I. Branchaeva, Zh. Mambetaly, and K. K. Abakirov, who were mentioned in an ELTR report about Kumarbek Abdyrov, accused of the rape and murder of 17-year-old Aysuluu. In 2016, the court reduced his prison sentence from 12 to 7 years, and in 2018 he was released on amnesty. Later, the judges who made the decision were dismissed during anti-corruption checks.
