The defense attorney is concerned that the actions of the investigative authorities and the court call into question the legality and validity of their decisions.
Interestingly, the injured party, the Public Organization "Kyrgyz Hunters and Fishermen Union," has not filed any claims against Zadorozhny.“The sales contract for the store 'Okhotnik' was concluded on September 9, 2015, with the approval of the presidium of the association, and the amount of 10.5 million soms was fully transferred to the organization's cash register, which excludes any accusations of embezzlement,” noted Abakirov.
It is also worth noting that 10 years have passed since the alleged offense, which under the legislation of the Kyrgyz Republic is grounds for terminating criminal prosecution.Despite this, on September 29, 2025, the Pervomaisky Court issued a decision to keep Zadorozhny in custody, even though he was undergoing treatment in a hospital for a diagnosis of "stage 3 hypertension." “This action violates human rights and exerts pressure on a person with a serious illness. As a result of the stress, Zadorozhny suffered an ischemic stroke on September 27, 2025,” added the lawyer.
Furthermore, investigator U. Ibraev sealed the store "Okhotnik" on November 31, leading to its closure. The defense attorney considers this an interference in lawful activities and views it as a raider seizure.
“The situation raises concerns due to the selectivity of the investigation. U. Ibraev is also handling a case regarding the embezzlement of 7 million soms involving Ch. D. uulu, who held the position of chairman of KORS from 2019 to 2024. Despite the facts of the internal audit, no measures have been taken against him,” emphasized Abakirov.
The lawyer has also submitted a number of requests to the authorities:
- immediately terminate the criminal prosecution against Zadorozhny due to the lack of a crime and the expiration of the statute of limitations;
- release Zadorozhny from custody due to his serious health condition;
- lift the seizure of the store "Okhotnik" to restore its operation;
- hold accountable the responsible officials for violating the law and exceeding their authority, which led to the deterioration of Zadorozhny's health.
