Former judge of the Ton district demanded the resignation of judges of the Bishkek city court

Gulzat Abdinasirova, who previously held the position of chairperson of the Ton District Court in the Issyk-Kul region, made a public statement regarding the decision of the Bishkek City Court in her case. She also addressed high-ranking officials, including President Sadyr Japarov, Chairman of the State Committee for National Security Kamchybek Tashiev, and Chairman of the Supreme Court Mederbek Satyyev.

Recall that Abdinasirova was arrested on September 27, 2024, on suspicion of corruption. She shared that she became a judge inspired by her mother, Jumakan Abdinasirova, who was also a judge and died in the 1990s while performing her official duties in the Osh region.

Abdinasirova believes that a fabricated criminal case has been initiated against her and suggests that personal interests of the plaintiff's son, who works in the State Committee for National Security, may be involved.

“I intend to defend my rights during an open court process. However, even at the initial stages of the proceedings, serious violations of legislation and principles of justice occurred, which raises doubts about the objectivity and fairness of the proceedings,” she noted in her address.

During the preliminary investigation, the plaintiff's son was allowed to participate in the case as a witness, but his testimony was not properly verified by either the first instance court or the appellate court. The court rejected all my motions to interrogate him, which contradicts the requirements of the Criminal Procedure Code of the Kyrgyz Republic and violates the right to a full judicial review,” the former judge added.

She also pointed out the actions of the judges of the Bishkek City Court, including Ataev Z. I., Baidaeva L. A., and Esenbaev A. M., who, in her opinion, systematically violated the law and her procedural rights.

Abdinasirova demands their resignation.

“Judge Ataev Z. I. abused his powers by considering and resolving motions in the case virtually unilaterally, undermining the principles of collegiality and appellate proceedings. Judges Baidaeva L. A. and Esenbaev A. M. exhibited inaction and negligence, as evidenced by video recordings where they were preoccupied with mobile phones, effectively distancing themselves from the process, while the law requires active participation from judges,” expressed her dissatisfaction the former chairperson of the Ton Court.

She emphasized that such behavior violates the principles of transparency and immediacy of judicial proceedings, hindering the objective evaluation of evidence and undermining trust in the judicial system.

“The actions of the aforementioned judges contradict the Code of Judicial Ethics of the Kyrgyz Republic, which requires judges to maintain a high level of professionalism, respect for the participants in the process, and impeccable conduct in the courtroom. The use of mobile phones during sessions demonstrates a disregard for their duties and raises doubts about the impartiality of the judicial proceedings,” she added.

During the proceedings, Abdinasirova and her defenders repeatedly filed motions to disqualify the entire court composition, including Judge Baidaeva L. A., who allowed herself inappropriate reactions and smirks, creating an unhealthy atmosphere in the courtroom,” she shared her impressions.

In her address to the country's leadership, the former judge called for an internal investigation regarding these judges, to assess their actions and, if violations are confirmed, to apply disciplinary measures, including possible early dismissal from their positions.

“Such a decision will help strengthen trust in the judicial system and protect the principles of legality and justice,” concluded her address Abdinasirova.
